Contest Policy
It is the policy of this Company that all contests promoted on the radio shall adhere to preprinted rules and adhere to FCC rules and guidelines.
FCC Rule 73.1216 states that “a licensee that broadcasts or advertises information about a contest it conducts shall fully and accurately disclose the material terms of the contest, and shall conduct the contest substantially as announced or advertised. No contest description may be false, misleading or deceptive with respect to any material term.” This rule applies to even where a station's only connectionwith a contest is to advertise it for another business. In this regard the FCC suggests that the broadcast copy dealing with contest should include:
- Complete information how the public may obtain the rules;
- The beginning and termination dates of the contest;
- How the public may enter the contest;
- The amount or nature of the Prize; and
- Where applicable, a statement that no purchase is necessary.
The FCC also cautions not to make any changes to the rules or operation of the contest after the contest is under way.
You may also want to limit the contest to listener's over the age of 18. If you choose to allow winner's under the age of 18 you should require that they be accompanied by their parents. Any winner under 18 years must have their parents or other legal guardian sign the Prize Receipt and Release.
The FCC also recommends for each promotional broadcast, that the station maintain a file regarding the contest. The file should contain a copy of the rules and eligibility requirements of the contest, a copy of the prize awarded, a “receipt-release” form signed by the winner, any letters of complaint, copies of all broadcast material pertaining to the promotion, any lay-outs, adds, billboards, or other media advertising used to promote the contest and a notation verifying the days and times the rules of the contest were broadcast (the rules should be broadcast at least once during each day part of each day of the contest)
If the station is providing the prizes to the winners, it may be required to file a 1099 MISC Federal Tax form. This requirement is imposed only for station-sponsored contests and not to promotions in which the station airs an advertisement for a non-station affiliated contest promoter. No employees or immediate family of the radio station 710 KNUS or people who have won in the last 90 days are eligiable for contest winnings. All contest are a chance not gurenteed. Chances may include raffle drawings, and/or random picking.
